Terms & Conditions

 

By booking a session with EvaGud Photography and signing your contract, you agree to the following terms and conditions:

    1. By signing your contract, you warrant that you have actual authority to agree to the use of the likeness of all persons included in the portrait, and you agree to indemnify and defend EvaGud Photography in the event of litigation arising from such use. Negatives, digital files, and previews remain the exclusive property of EvaGud Photography.
    2. Refunds on products are not available under any circumstances, as these are bespoke products that cannot be resold. This does not affect your statutory customer rights.
    3. EvaGud Photography reserves the right to reschedule a session due to illness, weather, equipment malfunction, or other circumstances beyond her control.
    4. If you arrive late to your session, the time you are late will be deducted from your allotted session time.
    5. EvaGud Photography has the right to ask any member of the client party to leave the premises if there is any threat of violence or inappropriate behaviour; no refund will be given in this case.
    6. If EvaGud Photography cannot fulfil this agreement due to illness, emergency, fire or other casualty, strike, natural disaster, act of God, or other cause beyond her control, all session fees paid will be rescheduled to an appropriate future date. If rescheduling isn’t possible, monies paid can be transferred to a gift voucher valid for 24 months.
    7. Copyright of all images created during the session remains with EvaGud Photography. Images may not be used for anything beyond personal use without prior written permission.
    8. You may share posts via direct links and tag yourself, friends and family in EvaGud Photography’s photos on social media, but you may not save, screenshot, or re-upload them.
    9. If you purchase digital files, you agree to act in accordance with the print release.
    10. You will not alter, crop or edit the photos in any way, at home or by other means (including black-and-white conversions or filters such as via Instagram or similar apps).
    11. You will not sell EvaGud Photography’s images without prior written permission from the photographer.
    12. Cameras, including mobile phone cameras, and recording devices may not be used during the session unless otherwise agreed with EvaGud Photography.
    13. EvaGud Photography is not liable for any accidents or injuries to individuals participating in the photoshoot; you are responsible for yourself and/or your child under the age of 18.
    14. Any damage to equipment or property belonging to EvaGud Photography or the studio, caused by you and/or your child under the age of 18, is your responsibility, and you agree to pay the cost of repair or replacement.
    15. EvaGud Photography is not responsible for loss or damage to digital files due to circumstances beyond her control.
    16. EvaGud Photography is not responsible for damage to portraits after delivery to you, including damage caused during transit by UK mail. You assume all responsibility for the safety of portraits upon receipt.
    17. EvaGud Photography has full creative control during your session and reserves the right to artistically interpret the scene, including styling, props, and the selection and editing of images presented.
    18. There is no guarantee of the number of images presented from your session; many factors contribute to this, including the cooperativeness of the subject.
    19. You may be under CCTV surveillance at the EvaGud Photography studio. Recordings are never shared publicly and are used only for the safety of all parties, unless required for an investigation.
    20. After you receive your order, all unpurchased images will be deleted from the photographer’s hard drive, except as needed for promotional purposes, at the photographer’s sole discretion.
    21. There are no refunds or exchanges on fees paid, due to the custom nature of photography.
    22. The package you choose to purchase at your viewing/ordering session is final and cannot be altered without charge.
    23. If you would like products sent by mail rather than collected in person, you agree to pay the associated postage cost. Loss or damage in transit is beyond EvaGud Photography’s control, and the photographer is not liable once an item has been sent; any replacements will be at your own cost.
    24. Payment for your chosen package is due at the viewing/ordering appointment, or by an agreed and signed date.
    25. Only the images presented at your viewing are available for purchase.
    26. Under no circumstances will RAW or unedited files be provided.
    27. If you have prints made elsewhere rather than through EvaGud Photography’s specialised photo labs, EvaGud Photography is not responsible for the colour, crop or quality, as these will not be a true reflection of the photographer’s final product.
    28. At the time of booking, you may choose whether to join the VIP mailing list to receive offers, early-bird releases for mini sessions, model call invitations and promotions via email. You will never be spammed, and you can unsubscribe at any time.
    29. At the time of booking, you may choose whether EvaGud Photography can use images from your session online and on social media, including in free studio sample products.
  1. This page reflects the entire agreement between you and EvaGud Photography regarding your session; any modification must be in writing and signed by both parties.
  2. Should any legal action be required to enforce or interpret this agreement, the prevailing party shall recover reasonable legal fees and costs.

Milestone Mini and Birthday Mini Sessions

The following also applies to Milestone Mini Sessions and Birthday Mini Sessions booked online. It does not apply to Christmas Mini Sessions or other seasonal or fixed-date mini sessions, which are covered by the terms above and the details given at the time of booking. No signed contract is needed for these sessions: by completing your booking and payment, you agree to these terms and conditions.

  1. Mini Sessions are paid in full at the time of booking. Your session time is confirmed only once payment has been received.
  2. The Mini Session price includes the session and 3 digital images of your choice from your online gallery. Additional images may be purchased after the session at the upgrade prices shown at the time of booking.
  3. Cancelling: if you cancel 14 days or more before your session date, you will receive a full refund. If you cancel less than 14 days before your session date, your payment is not refundable, but your session can be rescheduled as set out below.
  4. Mini Sessions run back to back. If you arrive late, the time you are late will be deducted from your session, and it may not be possible to go ahead if too little time remains.
  5. Mini Sessions are for one baby only, unless agreed otherwise in advance.
  6. Rescheduling: if you are unable to attend, please let me know before your session start time and your session will be rescheduled once, free of charge. The new session must take place within one month of your original session date.
  7. A rescheduled session is final: it cannot be cancelled, refunded or rescheduled again.
  8. If you do not attend and have not been in touch before your session start time, your payment will not be refunded and the session cannot be rescheduled.
  9. If your baby or anyone attending is unwell, please do not come to the studio. Let me know before your session start time and your session will be rescheduled as above. EvaGud Photography may decline to start, or may end, a session if a child arrives unwell; in that case the session will be treated as rescheduled.
